Deneillsons Electrical Terms and Conditions of Business
Issue 1 – May 2011

These Terms and Conditions shall apply to the provision of services by Deneillsons Electrical of 29 Briar Hill Road, Delapre, Northampton, NN4 8LL (“the Electrician”) to customers that require their services.

1. Definitions and Interpretation
1.1 Definitions
Agreement – The contract formed when the Customer accepts the Quotation and these Terms.
Agreed Date – The agreed start date of the Services.
Agreed Times – The agreed times the Electrician can access the Property.
Customer – The individual or business requesting the Services.
Final Fee – The total payable, shown on the invoice.
Job – Completion of the Services.
Order – The Customer’s request for Services.
Property – The location where Services are carried out.
Quotation – The estimate provided to the Customer.
Quoted Fee – The estimated cost, subject to change.
Services – Electrical services provided.
Visit – Any attendance at the Property.
Work Area – The part of the Property where work takes place.
1.2–1.5 General Interpretation

Covers references to writing, legislation, clauses, singular/plural, and gender.

2. Orders
Customers must provide full details of required work.
The Electrician will issue an estimate with costs and deposit.
Customers can amend before accepting (via phone, email, or post).
3. Errors or Discrepancies

Estimates may change if incorrect or incomplete information was provided.

4. Deposit
25% deposit required within 7 days of acceptance.
Work is not confirmed until deposit is paid (unless waived).
Deposit is non-refundable (subject to cancellation terms).
5. Fees and Payment
Fees include labour and estimated materials.
Final cost may increase if extra materials are needed.
Price increases will be communicated.
Invoices issued on completion or in stages.
Payment due immediately.

Late payment:

Interest at 8% above Bank of England base rate
£30 admin fee per late payment letter
Debt recovery costs may be added
6. Title

Materials remain the Electrician’s property until paid in full.

7. Certification
Work complies with certification schemes.
Certificates issued within 7 days (max 1 month after final payment).
8. Services
Work based on agreed estimate.
Work done with reasonable care and skill.
Complies with industry standards.
Waste disposed of appropriately.
Time is not of the essence (delays don’t automatically breach contract).
Customer has 7 days to report defects, which will be fixed free.
9. Sub-Contracting

Work may be subcontracted to qualified professionals at no extra cost.

10. Customer Obligations

Customer must:

Obtain permissions (planning, landlord, etc.)
Remove furniture if required
Keep work area clear
Provide access at agreed times
Provide utilities (electricity, water)
Give 48 hours notice for cancellations or be charged
11. Cancellation
Cooling-off:
7-day legal cooling-off period (for consumers)
Cancellation terms:
More than 28 days before → full refund
7–28 days before → refund minus deposit
Less than 7 days → no refund, full payment due
Electrician cancellation → full refund
12. Callouts

Emergency/unplanned visits:

Minimum charge applies
Travel and time must be paid even if cancelled
13. Liability, Indemnity and Insurance
Electrician holds public liability insurance
Liability limited to order value
Not responsible for customer misuse or failure to follow advice
Not liable for indirect losses (e.g. lost profit)
Cannot exclude liability for death or injury
14. Guarantee
12-month guarantee on work
Defects fixed free within this period
Does not cover misuse, damage, or neglect
15. Data Protection

Customer data:

Not shared without consent
Handled under Data Protection Act 1998
16. Notices
Must be in writing
Delivered via post, email, courier, etc.
Deemed received depending on delivery method
17. Termination

Either party can terminate if:

Serious breach not fixed within 7 days
Bankruptcy or insolvency

All outstanding payments become due immediately.

18. No Waiver

Not enforcing a clause doesn’t waive future rights.

19. Severance

If one part is invalid, the rest still applies.

20. Force Majeure

No liability for delays caused by events outside control (e.g. weather, war, strikes).

21. Dispute Resolution
Disputes go to arbitration
Arbitrator agreed or appointed by Law Society
Decision is final and binding
Costs shared equally
22. Consumer Rights

Statutory consumer rights remain unaffected.

23. Law and Jurisdiction
Governed by laws of England and Wales
Courts of England and Wales have authority
